These terms govern your use of the Culper platform at theculpernetwork.com. By creating an account or using the service you agree to them. If you don't agree, don't use the service.
What Culper is
Culper is a campaign operations platform for local political candidates. It provides voter-data management, SMS and email outreach, volunteer coordination, block-walking assignment, and payments through Stripe Connect.
Eligibility
You must be at least 18 years old and have legal capacity to enter into a contract. You must be using Culper in connection with a real political campaign, political committee, or party committee operating in the United States.
Your account
You are responsible for keeping your login credentials secure, for every action taken under your account, and for ensuring each member of your team you invite has a legitimate need for their level of access. We reserve the right to suspend accounts that show signs of compromise or misuse.
Your data
You retain ownership of data you upload to Culper — including voter files, volunteer records, and campaign content. You grant us a limited license to process that data solely for the purpose of providing the service.
Acceptable use
You agree that you will not:
- Use Culper to violate any law, regulation, or third-party right — including but not limited to the TCPA, CAN-SPAM, and applicable election law.
- Send SMS outreach without documented prior express written consent from the recipient, as required by federal law.
- Circumvent the suppression list. Once a contact opts out, no further messages may be sent to them through any campaign on the platform.
- Upload voter data you are not licensed to use. If your data comes from a vendor (L2, i360, Haystaqs, etc.), you are responsible for confirming your license covers this kind of usage.
- Attempt to access other campaigns' data, reverse-engineer the service, or probe its security controls without written permission.
- Use Culper for non-political commercial outreach.
Compliance with political messaging law
Political SMS requires a TCR-registered A2P 10DLC campaign brand. Culper provides tooling to support registration and maintains a global suppression list; you remain the responsible sender and are responsible for the content of your messages and for obtaining consent. Culper is not your law firm. When in doubt, consult counsel.
Payments
Subscription fees are billed per cycle at the rate agreed during onboarding. Donations collected through Stripe Connect flow directly to your campaign committee's Stripe account; Culper is not a party to those transactions beyond providing the interface.
Termination
Either party may terminate the service for any reason. Upon termination we'll provide a reasonable window for you to export your data. Persistent breach of these terms, fraudulent activity, or use that exposes the platform or other users to legal risk may result in immediate termination.
Warranty disclaimer and liability
Culper is provided "as is." We make no warranty that the service will be uninterrupted or error-free. To the fullest extent permitted by law, our aggregate liability for any claim arising out of these terms is limited to the fees you paid in the twelve months preceding the claim. This section will be tightened and made jurisdiction-specific during formal legal review.
Governing law
These terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Formal jurisdiction clauses will be finalized with counsel.
Changes
We may update these terms. Material changes will be announced to active customers by email at least 30 days before taking effect. Continued use after the effective date constitutes acceptance.
